A Division bench of High Court of Kerala, has dismissed the plea for C.B.I investigation by some public spirited persons, into the Perumbavoor Law Student rape and murder case.
The Bench comprising of Acting Chief Justice Thottathil B.Radhakrishnan and Justice Anu Sivaraman also slammed the print as well as visual medias for using and publicizing the name of the victim in the case. The Bench reminded and cautioned the media in strong words, that even a deceased person had a right against infringement of privacy, which has not been adhered in this case.
The Court declined the plea of C.B.I investigation, making an observation that no person in public domain has any unbridled right to seek for postmortem report and case dairies. It further opined that contents of an autopsy report forms part of the right to privacy and hence the same cannot be publicized.
The bench, also took note of the fact that a new team of investigation was constituted under the leadership of a lady superior officer, Mrs B.Sandhya I.P.S, Additional Director General Of Police. The bench opining that Judiciary cannot choose investigators or guide the investigation, further added that as in the instant case where investigation was progressing ,plea of C.B.I enquiry ought not to be entertained.
