    APCAM's first ADR Summit in India will be held on May 6th and 7th, 2023, at Hotel Le-Meridien in New Delhi. The Summit will gather top ADR institutions, renowned arbitrators, international chambers, and government representatives to discuss developments in disputes resolution in the Asia-Pacific region.

    Session 3

    "Exploring Unchartered Terrain: An Examination of Novel Disputes in ADR," will begin promptly at 04:30 p.m. and and will center around the theme “Exploring Unchartered Terrain: An Examination of Novel Disputes in ADR.” As with any dispute resolution process, ADR can still involve complex and novel legal issues that require careful examination. In particular, novel disputes may arise when parties use ADR methods such as mediation or arbitration to resolve disputes related to emerging technologies, intellectual property, or other areas of the law where there is little precedent. To ensure that these novel disputes are handled fairly and effectively, our Panelists will provide their unique insights into various aspects of these issues in this session.

    Panelist

    Justice Vibhu Bakhru, Judge, High Court of Delhi, will chair this session. The esteemed panelists include professionals from all around the world. The director of ADRC Australia, Ms. Delcy Lagones, will be the moderator for this session. In addition, the panel includes Mr. Bazul Ashhab, Managing Partner, Oon & Bazul, Singapore, Mr. Kyongwha Chung, Counsel, Covington & Burling LLP, S.Korea, Ms. Musyrifah Malek, Advocate & Mediator, Malaysia and Mr.Rajiv Mani, Addl. Secretary, Department of Legal Affairs, Govt. of India. Session 3 will be followed by Concluding Remarks by Mr. Matrika Niraula who is the General Secretary of NIAC, Nepal.

    This session will be a deep dive into the technicalities of arbitration, with a particular emphasis on how to enhance its value and tackle Novel Disputes in Alternate Dispute Resolution.
