Bhojpuri Actress Akanksha Dubey Suicide Case: Allahabad High Court Issues Notice To UP Govt In Mother’s Plea Seeking CBI Probe

A bench of Justice Anjani Kumar Mishra and Justice Vivek Kumar Singh heard the arguments of Advocate Saurabh Tiwari (appearing on behalf of the petitioner/Madhu Dubey) and issued a notice to the UP Government.

It may be noted that her petition, filed through Advocates Saurabh Tiwari, Arya Suman Pandey and Vikash Kumar, claims that the conduct of the local police in the matter from the stage of arriving at the scene of the occurrence to the filing of the charge sheet does not inspire confidence in the robustness of the process warranting a probe by the CBI.

In her plea, the Actress’ mother has alleged several irregularities in the investigation being conducted by the UP Police alleging that it is working in collusion with the criminals/culprits, hence the investigation has not been conducted impartially.

The petition raises strong doubts on the version of the UP Police that the actress died by suicide.

Her petition also flags certain serious issues including the non-addition of relevant sections of the Indian Penal Code have not been added in the charge sheet despite a finding in the Forensic Science Laboratory (FSL) report confirming the presence of sperm in the vaginal slide & vaginal swab stick of the deceased as well as her undergarments.

It has further been contended in the petition that even the DNA test of the accused/suspected person is also not available on record, and no effective approach is being made to match the DNA test outcome of semen/sperm with the suspected blood sample.

“…it is clear that from the initial stage, the investigation of this case is tainted and there is a real likelihood of justice being deflected. It is a strong possibility that CCTV footage also tempered with. And local police is in hand in glove with the culprits. Even the hotel room is unsealed hurriedly by the local police,” the plea submits.

It may be noted that Actress Dubey was in Varanasi for the shoot of a film and after the shoot ended, she headed to her hotel room wherein she was found dead on March 26, 2023.

In April, two accused, Samar Singh (singer by profession) and Sanjay Singh (business partner of Samar Singh) were arrested by the UP Police after conducting raids at various places by forming teams. Sanjay Singh has already been granted bail by the trial Court. Samar Singh's bail petition is presently pending before the High Court.
