The Madras High Court, in the case of U. Periyanayagi vs the Home Secretary, took into consideration the extraordinary circumstances of the convict and granted him a parole for three days in order to enable him to take care of some urgent and pressing matters.

This petition was filed by the wife of a convict serving life sentence in a prison in Tirunelveli to seek a month long parole for him. The parole was sought by Periyanaygi in order to enable her husband to make arrangements for mortgaging a property, medical expenses and other family needs. However, even though initially the petitioner had sought a parole for thirty days, she later on reduced the period to three days.

Considering the extraordinary emergency situation, parole was granted to the convict for a period of three days and a police escort was allocated to him to make the necessary arrangements. The petitioner was also directed to cover the batta costs of the escort.
