After singer Mika Singh and entertainer Rakhi Sawant publicly made amends, Singh has approached the Bombay High Court to quash with consent the 17-year-old case against him for forcibly kissing Sawant twice at his birthday party in 2006.

Singh states that Sawant’s allegations were a ‘misunderstanding’ and the scuffle thereafter between their friends was an “unplanned and sporadic incident.” Since they have had an opportunity to clear these misunderstandings there was no point in “continuing their differences,” Singh states.

The singer’s plea adds that “...the parties have amicably settled their disputes and to secure the ends of justice, it is expedient that the FIR and the Chargesheet be quashed”.

On Monday, the division bench of Justices AS Gadkari and PD Naik briefly heard the parties and posted the matter for further consideration next week after being informed that Sawant’s consent affidavit couldn’t be located in the High Court registry.

Advocate Ayush Pasbola for Sawant informed the court of the missing affidavit, after which the bench permitted him to file a fresh affidavit.

Advocate Falguni Brahmabhatt appeared for Singh. She informed the court that the case had been lying in the magistrate’s court for the past 17 years. A chargesheet was filed against her client in 2015 but charges were yet to be framed.

"They are now friends and hence have resolved their issues,” she said.

The petition adds that the duo has since worked together on multiple projects and are, even as on date, professionally associated with each other.

The matter will now be heard next Monday.

In the FIR registered at Oshiwara Police station on June 11, 2006 Singh and his helper Vicky Singh were booked for offences punishable under sections Section 354 (molestation) and 323 (battery) of the IPC.

Sawant alleged that the previous day on June 10, June 2006 at Republic Theatre, Andheri she attended Singh’s birthday party. She alleged that Singh invested her to cut his birthday cake along with him and when she obliged, he forcefully kissed her twice.

While she left the party immediately, their friends got into a scuffle and Sawant’s friend injured his eyebrow.

On June 17, that year a magistrate granted Mika anticipatory bail and on February 24, 2015, the police finally filed the chargesheet against the singer adding the section of criminal intimidation against him.
