SC Issues Notice In Petition Challenging Aman Mani Tripathi In Wife’s Murder Case [Read Petition]

    The Supreme Court on Tuesday issued notice to MLA Aman Mani Tripathi in a Special Leave Petition challenging the Allahabad High Court order granting him bail in March this year.

    The notices were issued by a Bench comprising Justice Sikri and Justice Bhushan, and the matter will now come up after three weeks.

    Mr. Tripathi, who is a sitting MLA from Nautanwa, Uttar Pradesh, had been charge-sheeted by the CBI in February for the murder of his wife, Ms. Sara Singh. “During the investigation, it was found that after her marriage, Sara Singh was allegedly being subjected to physical torture and cruelty by the accused. She was allegedly murdered on July 9, 2015 with a premeditated plan to get rid of her by the accused and others. The accused framed it as a fake road accident and presented the same as cause of death of victim Sara Singh,” the CBI had said in a statement.

    The Apex Court has now been approached by Ms. Sara Singh’s mother, Ms. Seema Singh, contending the High Court had failed to take into account Mr. Tripathi’s criminal background, and possibility of him tampering with the evidence if he is on the loose.

    She has further alleged that Mr. Tripathi has made attempts at threatening her, and has submitted, “Given his political background, the Respondent No. 2 has the potential of tampering with the evidence in the present case and thereby hindering with process of justice according to the due process established by law.

    Ms. Singh has, thereafter, raised the following questions of law for consideration by the Apex Court:

    “(a) Whether the Hon’ble High Court erred in allowing the bail application of the Respondent No 2 and thereby granting him release on bail?

    (b) Whether the Hon’ble High Court is right in granting bail to the Respondent No 2 without giving due consideration to the fact that a trial is still undergoing against him and he has a criminal history for the commission of serious offences?

    (c) Whether the Hon’ble High Court erred by not giving due weightage to the cogent findings and evidence adduced by the C.B.I. vide charge-sheet dated 17.02.2017 and the report of AIIMS Medical Board dated 20.012017 in the instant case?
