    Jagdeep Rana, who along with his friend Rajan umar Madan, has been jailed by the Delhi Assembly Speaker for creating ruckus in the House has once again moved the Delhi High Court challenging the Constitutional validity of the Assembly rules which allow Speaker to punish/ imprison anyone without granting a hearing.

    Jagdeep Rana has prayed the high court to “declare Rule 75 of The Rules of Procedure and Conduct of Business in the Legislative Assembly of the National Capital Territory of Delhi, 1997; ultra vires to The Constitution of India and same as void”.

    Rana has said in his petition that the Speaker punished his friend and him citing Rule 75 and did not grant them any hearing as he was under medical treatment at Aruna Asaf Ali hospital after he was roughed up by AAP MLAs.

    “It would be very pertinent to mention herein that the said order was passed in the absence of the petitioner, who was at that point in time under treatment at the hospital. The order is absolutely illegal and violates the principle of natural justice, which cannot be sustained and is liable to be set aside,” says the petition.

    Rana and Madan had in their earlier petition challenged their punishment. The high court has already issued notices to the Speaker on it.

    In this petition, Rana says, “Article 14 of the Constitution of India mandates that the state shall not deny to any person equality before the law or the equal protection of the laws within the territory of India. Rule 75 of The Rules of Procedure and Conduct of Business in the Legislative Assembly of the National Capital Territory of Delhi, 1997; deny equality before the law or the equal protection of the laws and distinguishes between one contemnor from another”.
