Supreme Court hears early hearing application filed in a PIL seeking enforcement of the rights of #ElderlyPersons under Article 21 of Constitution

The petition raised issues qua pension, shelter, geriatric care and medical facilities for the elderly, as well as implementation of the MWP (Maintenance and Welfare of Parents and Senior Citizens) Act

Dr Ashwani Kumar (in person) : Union was to file a status report on 3 issues - how many old age homes exist, what is the extent of pension being given, third was medical care. Continuing mandamus was issued. With great anguish, I want to point out that something needs to be done to prioritize these matters. It concerns crores of people, this is not heard for 6-7 years!

CJI: After 2022, we don't know why it has not been listed

Kumar: I mentioned 5 times myself after 2022. Aug 2023 - Union filed affidavit. Details of 15 states and 4 UTs given. Even today Union has not filed complete affidavit. So much time has elapsed. 2-3 weeks may be given to file updated affidavit

Union counsel says matter may be relegated to HCs

Kumar: This court has to enforce its own order. This is a strange submission. This matter needs all-India decision. It can't be left to HCs

CJI: Court should have laid down principles and left implementation to HCs.

Order: We request ld. Attorney General to write a communication to all Adv. generals/Standing Counsels of states/UTs to submit the latest status report wrt. establishment of old age homes and facilities being provided there. Such details shall be furnished by all states/UTs within 3 weeks from date of receipt of communication.
