AMS Legal a dynamic law firm is seeking an experienced and dynamic professional to lead their Commercial Litigation and Intellectual Property (IP) Filing & Litigation Department.

Name of the Post: Principal Associate (Commercial Litigation & IP)

Location: Chennai

Compensation: ₹11,00,000 per annum

Essential Qualification and Experience

• Bachelor of Laws (LL.B.) or equivalent from a recognized university.

• Active enrolment with the Bar Council of India.

• A minimum of 5 years of post-qualification experience focusing significantly on Commercial Litigation and Intellectual Property law.

Roles & Responsibilities

(A) Departmental Leadership & Management

• Lead, mentor, and manage a team of legal professionals (associates, paralegals, etc.) within the Commercial Litigation and IP divisions.

• Allocate resources, manage caseloads, set performance metrics, and ensure adherence to professional standards.

• Drive departmental growth, innovation, and efficiency in case management and IP portfolio handling.

• Conduct regular team meetings, performance reviews, and professional development training.

• Commercial Litigation

• Oversee and actively manage a portfolio of complex commercial litigation matters, including breach of contract, shareholder disputes, recovery suits, and commercial fraud.

• Develop litigation strategies, manage court appearances, draft pleadings, manage discovery, and oversee all stages of the dispute resolution process.

• Provide strategic counsel to clients on potential disputes, risk mitigation, and commercial settlements.

(B) Intellectual Property (IP) Filing & Litigation

• Direct the filing, prosecution, and maintenance of a client's IP portfolio, primarily focusing on Trademarks, Patents, and Copyrights.

• Develop and implement strategies for IP protection and enforcement, both domestic and international.

• Oversee and handle complex IP litigation, including infringement suits, passing-off actions, opposition and cancellation proceedings before various forums (High Courts, Tribunals, etc.).

• Advise clients on IP commercialization, licensing, assignments, and due diligence.

• Client Management & Business Development

• Serve as the primary point of contact for key commercial and IP clients, building and maintaining strong, long-term relationships.

• Ensure excellent client communication and service delivery, providing timely and strategic legal advice.

• Actively participate in business development initiatives, including preparing proposals, attending industry events, and cross-selling firm services.

(C) Core Competencies

• Strong expertise in the Code of Civil Procedure (CPC), Indian Contract Act, Specific Relief Act, and other relevant commercial statutes.

• In-depth knowledge of the Trademarks Act, Patents Act, and Copyright Act, along with rules and procedures for filing and litigation.

• Proven track record of independently handling complex cases and managing a legal team.

• Exceptional analytical, drafting, and negotiation skills.

• Demonstrated ability to handle clients effectively, understand their commercial needs, and deliver tailored legal solutions.
