Justice Salil Kumar Rai Stresses Simplicity In Advocacy, Says “High-Sounding Phrases Do Not Assist The Court”
Justice Salil Kumar Rai of the Allahabad High Court emphasised the importance of clarity and simplicity in legal advocacy, observing that “high-sounding phrases do not assist the Court.”
He was speaking during the fifth episode of the 'Beyond Judgement' interactive series organised by Dr. Rajendra Prasad National Law University (RPNLU), Prayagraj, on May 22, 2026, where he interacted with students and shared insights from his judicial and professional journey.
Reflecting on his entry into the legal profession, Justice Rai said his journey into law evolved gradually through persistence and experience rather than careful planning. Speaking about his early years at the Bar, he observed that young advocates often do not have the privilege of choosing their preferred field at the beginning of their careers and must work on matters that come their way. He also highlighted the importance of strong constitutional fundamentals for practice before the High Court.
Discussing the transition from advocacy to the Bench, Justice Rai said that becoming a judge requires a significant shift in perspective, where one must impartially assess the rights and positions of all parties with fairness and equity.
Addressing the challenges faced by first-generation lawyers, he rejected the notion that success in the profession depends upon family background. He observed that hard work, honesty, consistency and soft skills ultimately determine recognition in the legal profession.
Describing law as a “marathon”, Justice Rai remarked that professional growth may be gradual, but sustained effort and integrity eventually earn respect.
Speaking on advocacy, he said that law is not confined to statutes and precedents alone, but also involves clarity, persuasion and practical wisdom developed through experience. He reiterated that simplicity in presentation is often more effective than complicated arguments and high-sounding phrases.
Justice Rai also reflected on the increasing role of technology in the legal system, noting that while digital platforms have improved efficiency, they have also created practical challenges in virtual hearings. On judicial accountability and the rule of law, he observed that the State remains duty-bound to comply with judicial orders in both form and spirit.
