The Madras High Court recently rejected a plea to constitute a committee for monitoring the disrespect or insult of the national flag.

The Bench comprising Justice M. Sathyanarayanan and Justice M. Dhandapani observed that the constitution of such company is “neither practicable nor feasible”.

The Court was hearing a Petition filed by a practicing Advocate, Mr. N. Ranjith Kumar, who had contended that the national flag was being hoisted on a flag mast painted with the colors pertaining to specific political parties, instead of white color. He, therefore, demanded a committee to keep a check on such violations.

The Court, however, demised the Petition, noting the existing statutory safeguards prescribed for this purpose. “It is to be noted at this juncture that every Citizen of India is to respect and honour the Indian National Flag and, if anybody insults the National Flag, the consequences are provided under the Prevention of Insults to National Honour Act, 1971. If any complaint, in this regard, is made to the concerned official thereunder, the statute mandates to take appropriate action,” it observed.
