Allahabad High Court Issues Criminal Contempt Notice To Lawyer Who Misbehaved With A Civil Judge

The Allahabad High Court on Wednesday (11th November) issued a notice of Criminal Contempt to a Lawyer against whom, a complaint dated 6.11.2020 was made by Varnika Shukla, Civil Judge (Junior Division), Sadar, Pratapgarh.

The Bench of Justice Ritu Raj Awasthi and Justice Saroj Yadav observed,

"Prima facie, the conduct of Vijay Kumar Pandey, Advocate amounts to committing criminal contempt."
The Allegations

Notably, the allegations made against the Advocate are that he misbehaved with the Presiding Officer and used abusive language, created obstruction in the proceedings of the Court, manhandled the Court, tore, snatched and threw the order, terrorized and pressurized the Court.

It has been further alleged that he did not allow the Court to function, defamed the Court by making serious allegations of taking the money and giving the judgment misbehaved with the Court, brought down the dignity of the Court in public domain and undermined the authority of the Court.
High Court's Order

The High Court, in its order, noted that "the allegations made in the complaint dated 6.11.2020 are very serious in nature."

Further, the Court issued notice to Vijay Kumar Pandey, Advocate through Chief Judicial Magistrate, Pratapgarh.

It was directed that the notice may also be served on Vijay Kumar Pandey through the President of the Bar Association of District and Sessions Court, Pratapgarh.

The Matter has now been listed for further hearing on 7.12.2020.
On that date, the Court has ordered Vijay Kumar Pandey, Advocate to remain personally present before the High Court. It may be noted that the Court issued the notice to him, after perusing the office report dated 9.11.2020 submitted by the Registry.
As stated earlier, a complaint in this regard was also made by Varnika Shukla, Civil Judge (Junior Division), Sadar, Pratapgarh. Thereafter, the case was registered as Criminal Contempt and came before the Court under the orders of the Chief Justice.
