The Bombay High Court recently dismissed a petition seeking uniform rules and safety measures for public gathering for the celebrations of Ganpati Utsav.

A division bench of acting Chief Justice S. V. Gangapurwala and Justice Sandeep V. Marne observed that the petition has not suggested any safety measures.

"In the Writ Petition, not a single instance is narrated, as to how the safety measures are not taken. Further the Petitioner also not suggested any such measures."

The court noted that an earlier PIL filed in 2016 by the petitioner seeking similar reliefs was also dismissed.

In that PIL, the petitioner sought that no permission for celebrating Ganpati festival should be granted to unregistered Ganpati Mandals. It also sought action against Ganpati Mandals for collecting donations, and to frame guidelines for safety of the gathering people at Ganpati festivals.

The bench of then Chief Justice Manjula Chellur and Justice M. S. Sonak had disposed of that PIL on September 2, 2016 observing that there is no mention about a particular incident. Further, it observed that guidelines were already issued in an April 2015 high court judgment Shri Sharad Patil  v. State of Maharashtra

The court dismissed the present PIL observing, “In the present matter also, no such instances are provided for”.
