Bollywood actor Celina Jaitly has moved a complaint under the Domestic Violence Act against her Austrian-national husband Peter Haag demanding Rs 50 crore for continued harassment and cruelty she has been subjected to in her nearly 15 years marriage.
The complaint has been filed before the Judicial Magistrate at Andheri, Mumbai, wherein the actress has cited several instances of her husband abusing her and torturing her both physically and mentally.
The Judicial Magistrate has issued notice to Peter Haag on this complaint and asked him to respond by December 12.
"Prior to their marriage, the Complainant (Jaitly) was an independent, empowered and self-made individual with several achievements to her credit. After marriage, the Complainant worked intermittently till she had children, after which the Respondent (Peter) prohibited her from working on various pretexts and robbed her of her financial independence and dignity," her plea stated.
In her complaint through Karanjawala & Co., Jailtly has stated that she is constrained to move the present application on account of the severe emotional, physical, sexual, verbal and financial abuse meted out by her husband upon her to the extent that she was forced to flee their home in Austria in the middle of the night and return to India, leaving behind her three children.
According to Jaitly, she was forced to take permissions from Peter before accepting any small projects. She has further alleged that Peter hoodwinked her into giving him control of her assets and finances.
"The Complainant is currently out of work and has no money to pay for her legal representation...She is thus entitled to daily maintenance and upkeep in terms of the lifestyle enjoyed by the parties in Dubai amounting to Rs. 10,00,000/- (Rupees Ten Lakhs) per month," the plea stated.
As per Jaitly, her husband Peter has completely blocked her access to the children who are currently in his custody in Austria and thus she is entitled to an order directing the husband to grant her telephonic and virtual access to the children under Section 21 of the Protection of Women from Domestic Violence Act.
"The Complainant further submits that she is entitled to the sum of Rs, 50,00,00,000/- (Rupees Fifty Crore only) as Compensation under Section 22 of the Protection of Women from Domestic Violence from the Respondents for causing mental and physical violence to the Complainant. The Respondent has perpetrated domestic violence upon the Complainant which has been continued till date; therefore the Application is within period of limitation," the plea demanded.
