A Special Executive Magistrate on Saturday ordered release of Cockroach Janta Party (CJP) founder Abhijeet Dipke who was put under preventive arrest by the Delhi Police.

Dipke was produced before SEM of Mandir Marg police station. He was detained on Friday evening while he was on his way to Connaught Place to participate in the 'Lehra Do Tiranga' protest at Central Park called by CJP.

The conditions will be clear after the order is out. Dipke will be released shortly. He has to comply with the peace bond. One of the conditions will require him to maintain peace for one year.

As per police, action under Section 126/170 of the BNSS was initiated against Abhijeet Dipke. Neha Bora, also detained with him, was released earlier today after formal procedures.

Section 126 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) empowers an Executive Magistrate to take preventive action against any person likely to commit a breach of the peace or public disturbance.

Section 170 empowers a police officer to make a preventive arrest without a warrant or an order from a Magistrate to stop the commission of a cognizable offence.

Dipke was picked up from his home in Jhandewalan by the Delhi Police.

Friday afternoon, more than 20 Delhi Police personnel visited Dipke's residence and served him a notice directing him to refrain from any action that could prejudice the rights of citizens, traders, commuters, patients and others.

For context, Dipke, along with other CJP leaders Saurav Das and Ashutosh Ranka were detained earlier as well from inside the aircraft immediately upon their arrival in the national capital to protest against Chief Election Commissioner Gyanesh Kumar. They were released on a peace bond which directed them to maintain peace in the area for one year.

In a related development, CJP leaders Saurav Das and Ashutosh Ranka were again detained by the police recently on allegations of entering Jantar Mantar on October 13. Later, the SEM remanded them to five days of judicial custody after finding sufficient grounds to proceed against them over the alleged breach of bonds executed to maintain peace.
