The Delhi High Court has issued notice on a plea filed by an Advocate alleging that his mobile phone and internet devices were put under surveillance at the instance of his in-laws which were being intercepted without valid permission of the Government.
Justice Yogesh Khanna sought response of the Centre, Commissioner of Police and MTNL returnable of December 16, 2021.
The plea sought directions on the Central Bureau of Investigation (CBI) to conduct an investigation and to begin prosecution in the matter as per law in accordance with the complaints made by the him.
It was the case of the petitioner that despite filing an RTI seeking details in the matter, no adequate response was recieved.
With regards to MTNL, directions were also sought in order to supply the details or information mentioned in the RTI and also to impose penalties on MTNL for not providing the requisite information.
The petition also sought directions on Commissioner of Police for taking steps as per Law applicable thereby conducting proper investigation and prosecution in the matter as per his complaints against the accused persons and punish them.
The petitioner alleged that the accused persons had violated his fundamental right to privacy enshrined under Art. 21 of the Constitution of India.
It was also stated that the accused had misused the Government machinery for their personal use and revenge in matrimonial dispute in order to "harass the violence in the internal life and home affairs of petitioner and his family members".
"In the circumstances, at this stage, issue notice to respondents No.1, 3 & 4 only through all modes/email/whatsapp returnable on 16.12.2021," the Court said.
