The Delhi High Court has issued certain practice directions as to how early hearing applications in respect of company matters will be considered by the Court.

The said practice directions have been issued pursuant to the order dated November 26, 2021 passed in "Re-MIS JVG Finance Ltd."

According to the practice directions, in any application seeking early hearing of the company matter, the applicant shall be mandatorily required to give an undertaking that no other application involving issues connected to the application is pending.

It has been added that in case the undertaking is found to be incorrect, the application of early hearing would be liable to be rejected on that ground alone.

It has further been stated that in case any such connected application is pending, the applicant shall mandatorily disclose the details of all such applications.

The practice directions issued are as under:

- In any application seeking early hearing of the company matter, the applicant shall be required to give an undertaking that no other application, involving issues connected to the application of which early hearing is sought, is pending.

- If the undertaking is, found to be incorrect, the application of which early hearing is sought would be liable to be rejected on that ground alone.

- In case any such connected application is pending, the applicant shall mandatorily disclose the details of all such applications.

- This would include all the applications relating to the same property as well as applications, the outcome of which may be affected by the outcome of the application of which early hearing is sought. In such, a situation, the applicant shall be required to attach the copies of such application(s) (without the Annexures).

- No application, which does not conform to the above directions, shall be placed before the Court for consideration.
