Delhi Riots: Court Allows Tahir Hussain To Use Electric Kettle, Wooden Takhat Inside Jail On Medical Grounds
A Delhi Court on Tuesday permitted former Aam Aadmi Party councillor Tahir Hussain to use electric kettle and a wooden takhat inside the jail.
Additional Sessions Judge Sameer Bajpai allowed the plea filed by Hussain in the UAPA case alleging larger conspiracy in the commission of 2020 North-East Delhi riots.
Hussain's counsel submitted that he is suffering from various diseases which requires use of hot water on regular basis for smooth incarceration for which he need an Electric Kettle and Wooden Takhat.
It was further submitted that Hussain was always allowed to use the two things by recommendation of specialized Doctors and jail authorities.
As per Hussain, he has been using Electric Kettle and Wooden Takhat for the last five years and thus, he prayed that he may be allowed to continue using the same.
Allowing the plea, the Court noted that Hussain showed various medical papers in which he has been permitted to use Electric Kettle and Wooden Takhat.
“In view of the medical papers shown by the accused and the prayer made by him, the application is allowed,” the Court said.
“It is ordered that the accused Tahir Hussain may use Electric Kettle and Wooden Takhat as per the jail rules,” it directed.
The judge directed the Superintendent of concerned Jail to comply with the order.
Hussain has been denied bail in the case by the trial court on January 29. His bail plea in the UAPA case is presently pending before the Delhi High Court.
The accused, who were student activists in the forefront of organising anti-Citizenship Amendment Act protests in 2019-2020, are facing charges under the Unlawful Activities Prevention Act and the Indian Penal Code for allegedly formulating the "larger conspiracy" behind the communal riots which took place in the national capital in the last week of February 2020.
The accused in the UAPA case are Tahir Hussain, Umar Khalid, Khalid Saifi, Isharat Jahan, Meeran Haider, Gulfisha Fatima, Shifa-Ur-Rehman, Asif Iqbal Tanha, Shadab Ahmed, Tasleem Ahmed, Saleem Malik, Mohd. Saleem Khan, Athar Khan, Safoora Zargar, Sharjeel Imam, Faizan Khan, Devangana Kalita and Natasha Narwal.
