Tahir Hussain Moves Delhi Court Seeking Interim Bail In Delhi Riots Larger Conspiracy Case On Medical Grounds

Former Aam Aadmi Party Councillor Tahir Hussain has moved a Delhi Court seeking interim bail in relation to the 2020 North-East Delhi riots larger conspiracy case.

Additional Sessions Judge Sameer Bajpai of Karkardooma Courts yesterday issued notice on the application and sought response of the Delhi Police.

Hussain has filed the application for interim bail on the ground of his illness, particularly Hernia.

“Notice of the application, alongwith copy of it, be sent to the concerned Superintendent of Prison, for giving a report regarding the health condition of the accused. Notice of the application be also issued to the prosecution,” the Court ordered yesterday.

The matter is now listed for hearing tomorrow at 2:15 PM.

Recently, the judge dismissed the regular bail application filed by Hussain in the case, saying that he was denied the relief in 2024 as well wherein it was observed that the allegations against him were prima-facie true.

The judge had said that though the Supreme Court has recently granted bail to five co-accused namely Mohd. Saleem Khan, Gulfisha Fatima, Shadab Ahmad, Shifa-Ur-Rehman and Meeran Haider, but relief was denied to Umar Khalid and Sharjeel Imam on the grounds of them being the key conspirators.

The accused, who were student activists in the forefront of organising anti-Citizenship Amendment Act protests in 2019-2020, are facing charges under the Unlawful Activities Prevention Act and the Indian Penal Code for allegedly formulating the "larger conspiracy" behind the communal riots which took place in the national capital in the last week of February 2020.

The accused in the case are Tahir Hussain, Umar Khalid, Khalid Saifi, Isharat Jahan, Meeran Haider, Gulfisha Fatima, Shifa-Ur-Rehman, Asif Iqbal Tanha(granted bail in 2021), Shadab Ahmed, Tasleem Ahmed, Saleem Malik, Mohd. Saleem Khan, Athar Khan, Safoora Zargar(granted bail on humanitarian grounds as she was pregnant when arrested), Sharjeel Imam, Faizan Khan, Devangana Kalita (granted bail) and Natasha Narwal(granted bail).
