On Tuesday (22nd September) the Centre notified the appointment of Justice Sanjay Yadav as the Acting Chief Justice of the Madhya Pradesh High Court (as per Article 223 of the Constitution of India) with effect from September 30.

Significantly, Justice Sanjay Yadav has served as the Acting CJ of Madhya Pradesh High Court's in the year 2019 as well.

Presently, Justice Yadav is the senior-most judge of the Madhya Pradesh High Court after the present Chief Justice, Ajay Kumar Mittal, who will be retiring on 30th September.

The Centre's Notification reads,

"In exercise of the power conferred by Article 223 of the Constitution of India, the President is pleased to appoint Shri Justice Sanjay Yadav, senior-most Judge of the Madhya Pradesh High Court, to perform the duties of the office of Chief Justice of that High Court with effect from 3o September, 2020 consequent upon the retirement of Shri Justice Ajay Kumar Mittal, Chief Justice, Madhya Pradesh High Court."

Justice Sanjay Yadav's Profile

Justice Sanjay Yadav was born on June 26, 1959. He Enrolled as an advocate on August 25,1986. He practised on Civil, Revenue and Constitutional sides in the High Court of Madhya Pradesh at Jabalpur. He has also served the position of Deputy Advocate General of Madhya Pradesh.

He was appointed as a Judge of the High Court of Madhya Pradesh on March 2, 2007 and Permanent Judge on January 15, 2010.

It may be noted that In a letter addressed to the CJI Ranjan Gogoi, the Madhya Pradesh High Court Bar Association had on 06th September 2019, requested for the transfer of Justice Sanjay Yadav out of the State, owing to his "consistent misbehaviour".

Justice Sanjay Yadav was then the third senior most judge of the MP High Court. Since the Supreme Court Collegium had recommended elevation of the two senior-most judges of the high court, the Advocates apprehended that Justice Sanjay Yadav is next in line to take charge as the high court's Acting Chief Justice at its principal Bench at Jabalpur.

He was, in fact, appointed as Acting Chief Justice of the Madhya Pradesh High Court on October 06, 2019.
