MLA Rahul Mamkootathil Moves Sessions Court Seeking Bail In Third Rape Case
Palakkad MLA Rahul Mamkootathil has moved the Principal District and Sessions Court, Pathanamthitta seeking bail in the third rape case alleged against him.
Mamkootathil has approached the Sessions Court after his plea before the Judicial First Magistrate Court, Thiruvalla was dismissed on Saturday (January 17). The Sessions Court will hear the case on Thursday (January 22).
He was arrested on January 11 following the registration of the present crime, the third case alleging the same offence. The Magistrate had then allowed a custody application and granted three days for the custodial interrogation of the MLA.
The prosecution allegation is that Mamkootathil got acquainted with the victim through social media and that on April 8, 2024, he had induced her to book a hotel room where he committed rape on her. It is further alleged that the victim became pregnant as a result of the rape and she subsequently suffered a miscarriage. It is also alleged that Mamkootathil threatened her stating various things. He is accused of the offences under Sections 376 and 506(i) of the Indian Penal Code.
In his bail plea before the Magistrate court, Mamkootathil had urged that the sexual relationship with the victim was consensual and that he was unaware of the fact that the victim was a married woman. He had also submitted therein that the victim herself had booked the hotel room and came there on her own volition.
Mamkootathil had also made a case before the Magistrate that his arrest was illegal and there were many procedural irregularities in the case, including the non-communication of the grounds of his arrest.
When the matter came up for consideration, Sessions Judge N. Harikumar posted the case to January 22 for consideration.
