The Allahabad High Court has sought the UP Government's response in the bail application of a Mumbai resident who was arrested last month on the allegation of threatening to "blow up" UP CM Yogi Adityanath.

The single bench of Justice Alok Mathur on Friday asked the Additional Advocate General, appearing for the State, to seek instructions in the matter by July 15.

The Petitioner, Kamran Amin Khan is accused of sending a WhatsApp message to the UP Police's helpline number on May 21, threatening to "blow up" Adityanath.

A FIR was registered against him at the Gomti Nagar Police Station under Sections 505(1)(b) (Statements conducing to public mischief with intent to cause fear to the public), 506 (Criminal intimidation) and 507 (Criminal intimidation by an anonymous communication) of IPC.

He was arrested by the Maharashtra Anti-Terrorism Squad from Mumbai suburbs on May 23, 2020 and subsequently handed over to Uttar Pradesh Special Task Force for further investigation.

In his bail plea, Khan has contended that offences alleged against him under Sections 506 and 507 of IPC are bailable.

Further, he submitted that the offence under Section 505(1)(b), which is a non-bailable offence, could not be made out against him.

The court has granted time to the State to clear its stand on the matter.
