Supreme Court Issues SOP Mandating Strict Timeline Framework For Filing Legal Aid Appeals

The Supreme Court on Thursday (April 16) issued a comprehensive Standard Operating Procedure (SOP) prescribing binding timelines for translation, transmission, and filing of records in legal aid appeals, alongside directions for the creation of a unified digital platform to enable real-time monitoring.

The issue relates back to 2017, when the Supreme Court first took note of delays in legal aid appeals. Despite years of deliberations involving institutions such as the Supreme Court Legal Services Committee (SCLSC) and the National Legal Services Authority (NALSA), the problem persisted.

Data placed before the Court revealed that hundreds of legal aid applications remained pending, while systems failed to even track delays in filing appeals, highlighting structural inefficiencies in the legal aid framework.

Therefore, after years of deliberations with multiple stakeholders involved in framing the SoP to mitigate the issues of delays in legal aid appeal due to several factors such as ineffective translations, transmissions of records, etc., a bench of Justice Sanjay Karol and Justice N Kotiswar Singh today issued the SOP which introduces a three-tier categorisation of cases based on urgency for the purposes of translator assignment and translation of priority documents:

Category A: Death penalty, life imprisonment, and sentences of 10+ years – 15-day timeline

Category B: Medium-term sentences and human rights cases – 20-day timeline

Category C: All other cases – 30-day timeline

The Court emphasized that cases involving severe deprivation of liberty must be prioritised to prevent prolonged injustice.

Also, the Court has imposed a time-bound procedural chain covering every stage, from pronouncement of judgment to filing of appeals.

Key features include:

• Communication of judgments within 7 days

• Consent from convicts within 7 days

• Document collection within 10 days

• Translation within 15–30 days depending on category

• Filing of appeals within 15 days of receipt of records

The Court made it clear that these timelines are binding on all stakeholders, including High Courts, legal services authorities, jail officials, and translators.

Calling out poor translation quality as a recurring concern, the Court further directed High Courts to establish a dedicated translation cadre, with a strength not less than one-third of the sanctioned judge strength.

It also mandated that there shall be a strict qualification criterion for translators and supervisors, certification of accuracy and independence, and priority translation of key documents such as judgments, FIRs, witness statements, and exhibits.

Push for Digital Integration

In a significant technological push, the Court directed the development of a centralised digital platform within two months to integrate the functioning of SCLSC, High Court Legal Services Committees, and jail authorities.

The platform will feature:

• Real-time tracking dashboards

• Automated deadline alerts

• Secure document exchange

• Audit trails for accountability

NALSA's Member Secretary has been designated as the nodal authority to oversee implementation and monitoring.

Accountability Through Monitoring Committees

To ensure compliance, the Court ordered the constitution of Monitoring Committees at both the Supreme Court and High Court levels. These committees will meet fortnightly to review progress, identify delays, and evaluate the performance of all stakeholders involved in legal aid delivery.

Mandatory Delay Disclosure Format

In a move to enhance transparency, the Court introduced a standardised checklist for condonation of delay applications. Appeals filed through legal aid must now disclose a complete timeline, from judgment upload to filing, along with explanations for any delay.

The Registrar (Judicial) was directed to circulate a copy of this order to the Registrars General of all the High Courts, who shall ensure a copy of the same is placed before the Learned Chief Justices and the Executive Chairpersons of the State Legal Service Committees, for necessary follow-up action and requisite changes as may be required.

The Court asked the concerned stakeholders to submit the compliance report by 30th April 2026. The matter shall come up before this Bench for further consideration on 4th May 2026.
