The Ministry of Home Affairs has notified that the Central Armed Police Force (General Administration) Act 2026, has come into effect from October 8, amid the hearing of petitions challenging the legislation's constitutionality before the Supreme Court.

The notification issued by the MHA stated :

"In exercise of the powers conferred by sub-section (2) of section 1 of the Central Armed Police Forces (General Administration) Act, 2026 (9 of 2026), the Central Government hereby appoints the 08th day of October, 2026, as the date on which the provisions of the said Act shall come into force."

The Act has provisions that 50% of the total posts in the rank of Inspector General and a minimum of 67% of the posts in the rank of Additional Director General and all posts in the ranks of Special Director General and Director General shall be filled by Indian Police Service (IPS) officers on deputation.

The Bill was moved to override the 2025 Supreme Court ruling in Sanjay Prakash & Ors. v. Union of India & Ors which held that CAPF personnel were entitled to promotion to Group A Posts. Hence, these posts should not be filled by IPS officers on deputation.

 The Supreme Court bench of Justice Manoj Misra and Justice Ujjal Bhuyan (who authored the 2025 judgment) is hearing the petitions challenging the CAPF Act as well as the contempt petitions alleging IPS deputations in violation of the 2025 judgment.
