Supreme Court hears play by "Mohammad Deepak" to quash FIR against him for confronting Bajrang Dal members who allegedly objected to a Muslim shopkeeper using the word 'Baba' in his shop's name.

Senior Advocate Abhishek Manu Singhvi: I am a Gym owner. On the same day there are FIRs by me on which no action is taken. The incident happened against the person calling his shop Baba. The victim also registered an FIR. I went to help him. How can a good samaritan be subjected to this kind of a complaint?

Singhvi: there is videography evidence which shows that the order is very strange. No reason is given for not quashing. There is the rioting charge and no essential ingredient is made out so that is dropped. But no ingredient was made out and 191 was added.

Singhvi: all offences are punishable for less than 7 years therefore Avnish Kumar guidelines have to be followed. No issue with that. A blanket gag order was given restraining the petitioners who are facing investigation from sending any message or video on social media platform regarding the incident.

Order: issue notice returnable within 4 weeks. In the meantime proceedings pursuant to the impugned FIR shall remain stayed and also the effect of operation of the impugned order passed by the High Court.
