Plea Seeking FIR Against Justice Yashwant Varma Mentioned In Supreme Court

A petition seeking the registration of FIR against Justice Yashwant Varma over the cash-at-home row was mentioned before the Chief Justice of India Surya Kant for urgent listing.

Advocate Mathews J Nedumpara mentioned the matter, saying that the Registry was refusing to list the matter.

"The matter has to be listed, your lordship can dismiss the matter. But let the Registry number and list it," he urged. Another petitioner, appearing in person, submitted that the charges against Justice Varma has been proved by the Lok Sabha Enquiry Commmittee, and hence, there should be no impediment in the registration of FIR. "Let there be equality and equal treatment, this Court has the power to order the registration of FIR," he submitted.

CJI Surya Kant however did not expressly state anything about listing.

Last month, the Supreme Court (bench of Justice PS Narasimha and Justice Alok Aradhe) had dismissed a PIL filed by Ghanshyam Upadhyay seeking FIR against Justice Varma. Earlier this week, the Delhi High Court dismissed another petition seeking CBI probe against the Judge.

Justice Varma, a former judge of the Delhi and Allahabad High Courts, had submitted his resignation in April while the Lok Sabha enquiry was pending. The Lok Sabha enquiry panel, constituted under the Judges Inquiry Act, submitted its report to the Lok Sabha in August, finding the charges against Justice Varma as proved.
