The Supreme Court recently sought a response from the Registrar Generals of the High Courts of Karnataka, Kerala and Orissa on the status of setting up Commercial Divisions dealing with admiralty cases.

The bench of CJI Sanjiv Khanna and Justice Sanjay Kumar was hearing a commercial suit relating to admiralty and maritime law, when a circular dated 24.02.2022 issued by the High Court of Karnataka was noted by the bench.

As per the Circular,  a commercial division consisting of a Single Judge has been constituted, each for the Principal Bench at Bengaluru and Benches at Dharwad and Kalaburagi.

The bench was hearing a challenge against the order of Karnataka High Court's Division Bench which upheld the interim arrest of the petitioner's Vessel which was seized for the purposes of recovering a due sum of Rs.17,84,91,641.64/- with 2% interest.

The Court was further informed that the High Courts of Orissa and Kerala have not constituted commercial divisions with regard to admiralty.

To verify the veracity of the above submissions, the Court issued notice to the three High Courts in the following terms :

We deem it appropriate to issue notice to the High Courts of Karnataka, Kerala and Orissa to ascertain facts and their views. Notice will be served through the Registrars General of the respective High Courts.”

Further, the Court also sought assistance of the Attorney General R Venkataramani.

We also deem it appropriate to issue notice to the learned Attorney General, who will appear in the matter and assist the Court.”

Matter will now be heard in March.
