The Supreme Court on Friday (July 17) dismissed a petition filed by the Rajkot Bar Association seeking transfer to the Top Court of a petition pending before the Gujarat High Court concerning the suspension of the Association's Secretary and issues relating to the functioning and strengthening of the Bar Association.

Before a bench comprising Justice Dipankar Datta and Justice Sheel Nagu, Senior Advocate Asim Pandya referred to a February order passed by the Court in a suo moto reference, which arose out of a Madras High Court decision on dispute over membership to the Madras Bar Association.

Refering to the order, he submitted that the present plea raises a similar issue and therefore pleaded that the matter be transferred to it.

To this, Justice Datta replied that the present petition doesn't concern the strengthening of the bar associations matter and therefore the Court will not entertain it. He added: "Strengthening of the Bar is for the interest of the stakeholders and not at the instance of a particular individual. Just go to the High Court. This has got nothing to do with the strengthening matter. Strengthening matter is only to ensure there is no strike..."

Pandya pleaded that State Bar Council has been interfering with the day to day activities of the association. But the Court reiterated that the remedy can be pursued before the concerned writ high court.
