The Supreme Court bench comprising Chief Justice DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala on Monday (6th February 2023) issued notice to the States of Bihar, Madhya Pradesh, and Maharashtra to consider the issue of monitoring of premature release of prisoners.

The notice was issued when the court was hearing a matter concerning remission of convicts in the State of Uttar Pradesh. The bench took note of the repeated instances concerning premature release of prisoners which kept on coming before the court resulting in the invocation of Article 32 of the Constitution.

Thus, CJI DY Chandrachud, while dictating the order in the matter said–

"We are intending to institutionalise the process for considering premature release in terms of the governing statutory provisions for effective monitoring of the process."

Accordingly, the bench issued notice to the States of Bihar, Madhya Pradesh, and Maharashtra to consider the issue of monitoring of premature release of prisoners.

CJI DY Chandrachud remarked–

"We have issued notice for other states as well because we want to monitor the other states too."
