National Green Tribunal Orders Action In Dwarka Omaxe Project Case

The National Green Tribunal (NGT), Principal Bench, New Delhi, has passed a significant order in Original Application No. 137/2025 (Renu Bala vs. MoEF&CC & Ors.), concerning alleged environmental violations in “The Omaxe State” project located in Dwarka, New Delhi.

The bench comprising Justice Prakash Shrivastava (Chairperson) and Dr. A. Senthil Vel pronounced the order on April 22, 2026.

Key Findings

The Tribunal found that no Environmental Clearance (EC) has been granted to the project by the Ministry of Environment, Forest and Climate Change (MoEF&CC).

The claim of “deemed environmental clearance” by the project proponent was rejected.

Evidence, including satellite imagery, indicated illegal felling of trees at the project site prior to obtaining necessary approvals.

The Tribunal also found indications of construction activity carried out without proper environmental permissions, contradicting the developer's claims.

Tribunal Directions

The NGT issued the following directions:

The Tree Officer/DFO has been directed to conduct a site inspection and determine the extent of illegal tree felling, and take punitive and remedial action within 8 weeks.

The MoEF&CC has been directed to decide on the pending Environmental Clearance application, taking into account the violations.

The Delhi Pollution Control Committee (DPCC) will assess environmental violations and impose environmental compensation if required.

Authorities must submit an Action Taken Report within three months.
