TMC MP Abhishek Banerjee's Parents Move Calcutta High Court Against KMC Notice Alleging Unauthorised Construction At Residence
The parents of Trinamool Congress MP Abhishek Banerjee have approached the Calcutta High Court seeking the quashing of a notice issued by the Kolkata Municipal Corporation (KMC) alleging unauthorised construction at their residence in south Kolkata.
According to the petition, filed by Amit Banerjee and Lata Banerjee, the property situated at 29-C, Harish Chatterjee Street, was constructed in accordance with the law and does not involve any unauthorised construction. The plea contends that despite the structure being authorised, the civic body issued a notice alleging illegal construction.
The matter is scheduled to be taken up by the vacation bench of the Calcutta High Court presided over by Justice Smita Das De.
The impugned notice was issued under Section 400(1) of the Kolkata Municipal Corporation Act, 1980. The provision empowers the municipal authorities to initiate proceedings in respect of alleged unauthorised constructions and affords the owner an opportunity to appear before the authorities and present their case.
The challenge arises against the backdrop of notices issued by the KMC to multiple properties allegedly owned or co-owned by Abhishek Banerjee, his family members, or associated entities. The civic body had sought documents relating to sanctioned building plans and explanations regarding alleged deviations from approved plans. The notices also warned of demolition proceedings in the event of non-compliance or failure to satisfactorily explain the alleged deviations.
Among the properties that came under scrutiny were premises at Harish Mukherjee Road and Kalighat Road. In relation to the Kalighat Road property, the notice was reportedly served upon Lata Banerjee. KMC authorities subsequently indicated that time had been sought to respond to the notices.
