The Calcutta High Court on Monday declined to grant an urgent hearing to an application filed by Trinamool Congress MP Abhishek Banerjee seeking permission to travel abroad for specialized eye treatment, directing that the plea be listed in the regular monthly list for July 2026.
Justice Saugata Bhattacharya refused the request for urgent listing after Senior Advocate Ayan Bhattacharjee mentioned the matter, stressing the medical urgency arising out of Banerjee's need for specialised ophthalmic care following an earlier eye surgery.
The application has been filed in connection with WPA No. 11489 of 2026, in which Banerjee had earlier secured interim protection from coercive action by investigating authorities.
By an order dated May 21, 2026, a single-judge Bench of the High Court had restrained the investigating agencies from taking coercive steps against Banerjee. However, while granting interim protection, the Court imposed a specific condition that Banerjee would not leave the country without obtaining prior leave or express permission from the Court.
Invoking this condition, Banerjee has now sought a limited relaxation of the travel restriction, seeking permission to travel abroad for seven days to undergo specialised eye treatment necessitated by his medical condition.
When the matter was mentioned on June 29, Senior Advocate Ayan Bhattacharjee urged the Court to take up the application urgently in view of the medical exigency.
Justice Bhattacharya, however, declined to entertain the request for urgent listing and directed that the application be placed in the regular monthly list for hearing in July 2026.
