Calcutta High Court Restrains Deportation Of Man Arrested On Suspicion Of Being Foreigner While Travelling To Bangladesh
The Calcutta High Court vacation bench has restrained the authorities from deporting a man to Bangladesh after he was detained on suspicion of being a foreign national while travelling to the neighbouring country with a valid Indian passport and a Bangladeshi visa.
The Court passed the interim order in a habeas corpus petition filed by the detainee's sister, who had raised concerns over his detention and apprehended deportation.
The man, identified as Mainul Hoque Khan, had been picked up along with his wife by the authorities.
Directing the respondent authorities to place a report before the regular bench, the Court sought an explanation regarding the circumstances leading to Khan's arrest and whether any legal proceedings had been initiated against him.
The Court ordered:
"The respondent authorities are directed to file an appropriate report before the regular bench, indicating the circumstances behind the arrest of the detainee and whether any legal proceedings have been undertaken against the detainee."
It further restrained the authorities from deporting Khan to Bangladesh without undertaking legal proceedings against him.
"The respondent authorities are restrained from deporting the detainee without undertaking any legal proceedings till 24th December or further orders," the Court directed.
The matter will be considered by the regular bench on the next date of hearing.
