Calcutta High Court Stays Coercive Action Against TMC MLA Paresh Ram Das After 6 FIRs Registered On Same Day

The Calcutta High Court on Thursday restrained the West Bengal Police from taking any coercive action against Trinamool Congress MLA Paresh Ram Das in connection with six FIRs lodged against him on May 16 at Canning Police Station.

Justice Saugata Bhattacharyya passed the interim order while hearing a petition filed by the MLA seeking protection from arrest and coercive steps. The protection has been limited to the six FIRs in question and will remain in force till June 30, 2026.

The Court ordered: “No coercive steps shall be taken against the petitioner without the leave of the court till 30-06-2026. However, investigations shall be carried out in accordance with law, and the petitioner shall cooperate with the investigating agency.”

During the hearing, the Court observed that five out of the six FIRs related to incidents allegedly dating back to 2021. The Bench also expressed prima facie doubts regarding the genuineness of the sixth complaint.

The Court noted that the petitioner's name appearing at the bottom of one complaint appeared to have been written differently.

“Prima facie it appears the petitioner's name at the bottom of the complaint was written in a different manner,” the Court observed, while clarifying that it was not making any conclusive finding at the present stage since the investigation was still at a nascent stage.

Senior Advocate Kishore Datta, appearing for Das, argued that the FIRs were a result of political vendetta following the recent change in political circumstances in the State. It was submitted that most of the allegations pertained to old incidents from 2021 and that multiple FIRs had suddenly been registered together.

Opposing the plea, Additional Advocate General Rajdeep Mazumder contended that the FIRs involved serious allegations and that the investigation should proceed unhindered.

While granting interim protection, the Court clarified that the State would be at liberty to seek vacation of the order if the MLA failed to cooperate with the investigation.
