The Delhi High Court has deleted a bail condition imposed on an accused mandating him to share his location 24 x 7 through Google with the Investigating Officer.

Justice Vikas Mahajan relied on the ruling of the Supreme Court in Frank Vitus v. Narcotics Control Bureau wherein it was held that court cannot impose a condition on the accused to keep the police constantly informed about his movement from one place to another.

The Court allowed the plea filed by one Harinder Bashishtha, seeking deletion of the condition imposed upon him by the trial court while granting him bail on June 21.

The counsel appearing for the accused submitted that such a condition could not have been imposed by the trial court while granting bail, and relied on the Frank Vitus judgment.

Referring to the ruling in question, the Court said:

“This Court is of the view that the condition as noted above could not have been imposed by the learned Additional Judge while granting bail to the petitioner.”

“Accordingly, the condition to the effect that the petitioner “should also share his location 24 x 7 with the IO through Google” is not sustainable and the same is accordingly deleted,” it added.
