Can Jailed MP Engineer Rashid Be Released On Bail With Stringent Conditions? Delhi High Court Asks NIA
The Delhi High Court on Wednesday asked the National Investigation Agency (NIA) whether Baramulla MP Abdul Rashid Sheikh (Engineer Rashid), jailed in relation to a terror funding case, can be released on bail with stringent conditions, including staying only in the national capital.
A division bench headed by Justice Prathiba M Singh asked Senior Advocate Siddharth Luthra appearing for NIA to obtain instructions and listed the matter for hearing on November 03.
The Court was hearing Rashid's appeal challenging a trial court order denying him bail in the UAPA case.
Earlier, he was granted bail to attend his father's last rites and to attend his 40th day ceremony in Kashmir.
Opposing bail, Luthra today submitted that there was sufficient material against Rashid which warrants denial of relief to him. He added that on one occasion when Rashid was granted bail, he tried to influence a witness which could be seen from call data records.
Luthra also argued that allegations against Rashid were serious and that he is accused of indulging in anti national activities and also has connections with a terrorist.
As Luthra said that testimonies of two witnesses are crucial in the case, including one protected witness, the Court ordered that their statements be recorded before the trial court before the next date of hearing.
Rashid was elected from the Baramulla constituency in the 2024 Lok Sabha elections and has been lodged in Tihar Jail since 2019 after the NIA arrested him under the Unlawful Activities (Prevention) Act in an alleged terror-funding case.
In January the high court had dismissed Rashid's appeal challenging an order framing charges against him in a UAPA case, stating that it is an interlocutory order against which appeal is not maintainable.
In doing so, the court referred to a coordinate bench's decision in December 2025 which had held that a charge order cannot be challenged in appeal under NIA Act as it is interlocutory in nature.
