Delhi High Court Issues Notice On Actor Salman Khan's Plea Against Release Of 'Kala Hiran' Movie
The Delhi High Court on Friday plea issued notice on an interim application filed by Bollywood actor Salman Khan seeking to restrain the makers of the proposed film “Kala Hiran: The Battle for Legacy.”
A vacation bench comprising Justice Neena Bansal Krishna issued notice on interim injunction application against release of the film. The application has been filed by the actor in his suit seeking protection of his personality rights.
Appearing for Khan, advocate Nizam Pasha submitted that on May 29 a poster has been released of the film in question containing a person, who bears the actor's likeness. He referred to high court's earlier order protecting the personality rights of the actor.
"A film is sought to be made exploiting my personality rights. We are asking for an injunction on this film.Total 4 FIRs, in 3 i have been acquitted. Now film is made exploiting my personality rights. Every day in press my name is bandied. We are asking for injunction of the film. This morning they have released trailer," he said.
The court asked about the release date of the movie. Pasha said that the Trailer is released but there is no release date announced for the film.
"We are asking for this project to be injuncted," he said. At this stage the court said that notice is required to be issued to the defendants.
The actor has alleged that the proposed movie unlawfully exploits his personality rights and falsely portrays events associated with him.
According to the plea, the film is stated to be inspired by Khan's 1998 blackbuck poaching case and his alleged rivalry with gangster Lawrence Bishnoi.
The actor contends that promotional material released by the makers contains unmistakable references to him, including the depiction of a lookalike wearing his iconic blue bracelet, which has become uniquely associated with him in the public imagination.
The plea further alleges that one of the posters depicts the lookalike holding a rifle or gun, thereby creating a misleading narrative contrary to judicial records.
As per the actor, such portrayal is particularly objectionable in light of his acquittal in proceedings under the Arms Act and is capable of misleading the public regarding actual events.
It is alleged that despite receipt of a legal notice dated April 24, the producers continued to publicise the film and repost content linking it to Khan.
Khan contends that the proposed film constitutes a gross violation of his recognised personality rights. He thus sought immediate injunctive relief against its development, production, publication and promotion.
The matter is listed for June 19.
