Delhi High Court Finds Someone Added 'Interim Stay' Para To Its Order, Calls For Investigation
The Delhi High Court has flagged an apparent fabrication of one of its orders, observing that an unknown person seemed to have added the words “interim stay granted” in it.
Justice Purushaindra Kumarav was hearing a plea filed by one Meena Devi and another individual, alleging police inaction on their complaint concerning alleged fraud and forgery in an attempt to grab their property in city's Khera Khurd area.
During the proceedings, the petitioners' counsel drew the Court's attention to an order purportedly passed by the High Court on November 19, 2024.
The Court examined the actual order passed on that date which had recorded that the respondents' counsel had sought time to seek instructions and the matter was listed for January 14, 2025. The order also directed that the trial court record be requisitioned.
However, the petitioners produced another version of the order in which an additional paragraph had been inserted stating: “Interim stay granted.”
On this, the Court observed: “A bare perusal of the above would reveal that some unknown person seems to have fabricated the order passed by this Court and added para. 4 containing the words 'interim stay granted'.”
It held that the aspect required investigation and appropriate action.
The Court accordingly granted liberty to the petitioners to approach the Registrar General with a detailed representation enclosing copies of both versions of the order.
It directed that, if such a complaint is filed, the matter be taken to its logical conclusion.
The Court also granted liberty to the petitioners to make a detailed representation to the Commissioner of Police.
“In turn, the Commissioner of Police is directed to inquire into all the aspects and to take appropriate action in accordance with law within a period of two months from the date of receipt of the representation to be filed by the petitioner,” the Court said.
