Delhi High Court Fines Lawyer For Failing To Inform Opposite Side's Counsel While Seeking Adjournment

The Delhi High Court has recently fined a lawyer for failing to inform the opposite side's counsel while seeking an adjournment.

Justice Anish Dayal imposed costs of Rs. 15,000 on the lawyer appearing for the respondent side in a plea filed under Section 115 read with Section 151 of the Code of Civil Procedure, 1908.

The petitioners sought review of an order passed in July 2024 vide which the application filed by the defendants under Order VII Rule 11 of CPC was dismissed.

On January 28, an adjournment request was made on behalf of counsel for respondent which was objected to by counsel for petitioners on the ground that even on the previous two dates, an adjournment request was made.

The proxy counsel representing the respondent stated that he had to travel outside Delhi for another matter in another State.

The Court noted that the counsel appearing for the petitioner was not informed about the same in the morning.

On this, the judge said:

“This manner of not informing the counsel of opposite side is strongly deprecated by the Court, since it causes inconvenience to other side's counsel, for no reason whatsoever.”

“Accordingly, cost of Rs.15,000/- shall be paid by counsel for respondent to counsel for petitioners within a period of two weeks,” it ordered.
