Delhi High Court Grants Interim Bail To Accused With Tuberculosis After Condition Worsens Due To Air Pollution

The Delhi High Court recently granted interim bail to an accused in a murder case suffering from tuberculosis after his condition worsened due to severe air pollution in the city.
Justice Swarana Kanta Sharma granted 15 days interim bail to Mohd Shaukat Ali alias Dolly, noting that he was earlier granted similar relief but never misused the liberty.
Ali is accused in an FIR registered for the offences under Section 302 and 34 of the Indian Penal Code, 1860.
He was granted interim bail on October 04 by the trial court as he is a patient of tuberculosis and was admitted in hospital for treatment. He was discharged on October 23 from the hospital. Later, his interim bail was extended on October 15.
It was his case that due to the air pollution in Delhi, he was unable to breathe properly and had also fainted due to breathing problems.
On the other hand, the prosecution argued that the allegations against Ali were serious in nature. However, his medical condition was not disputed.
Granting relief to Ali, the Court said:
“Considering the overall facts and circumstances of the case, this Court takes note of the fact that the applicant/accused is suffering from Tuberculosis, which is not disputed. This Court further notes that on earlier occasions also, the applicant was granted interim bail and he has never misused the liberty so granted to him.”
