The Delhi High Court has sought response of the Delhi Police on the prosecutions launched in the last one year against those who violated the policy barring placing of hoardings and banners on public buildings and places during the elections.
A division bench comprising Chief Justice DK Upadhyaya and Justice Tushar Rao Gedela issued notice on a PIL filed by Jan Sewa Welfare Society.
The plea sought a direction on the authorities to implement the policy in question which was framed to give effect to the provisions of Delhi Prevention of Defacement of Property Act, 2007.
The Court noted that the policy cast duties on the civic bodies to take action against the placement, generally the placement of posters or hoardings or banners on public buildings and spaces generally put up during the polls.
It directed the Municipal Corporation of Delhi (MCD) to file an affidavit bringing on record the necessary data in respect of the action which might have been taken during past one year for implementing the policy in question.
“Learned counsel representing the Delhi Police shall also file an affidavit bringing on record, the prosecutions launched during past one year under the Delhi Prevention of Defacement of Property Act, 2007,” it said.
The Court directed the MCD and Delhi Police to file their affidavits within four weeks.
The matter will now be heard on February 11, 2026.
