The Gujarat High Court has granted bail to a man over his alleged role in assaulting the complainant in connection with an altercation over feeding of stray dogs. [2026 LiveLaw (Guj) 83]
Applicant is accused of coordinating an assault on a society resident who had an altercation with another resident over feeding stray dogs.
It is alleged that the person with whom complainant had an altercation had called outsiders to assault the complainant, and it is the Applicant who was involved in bringing these outside persons.
Justice Nikhil S Kariel while granting the Applicant relief observed,
"...the present applicant is in custody since the 05.10.2025, charge-sheet is filed and whereas while the applicant is stated to have 10 antecedents, learned Senior Advocate Mr. Syed has tendered a chart which would show that out of the 10 in 08, the applicant has been acquitted, in one which is under the Gambling Act, the applicant has been imposed with a fine of Rs.500 and one serious offence, under Section 307, the applicant has been released on bail. Having regard to such an aspect, while this Court is inclined to consider this application yet, having regard to the fact that this is the second offence under old section 307 against the present applicant under the very police station, appropriate safeguards are required to be imposed."
Taking note of the facts and circumstances of the case and considering the nature of the allegations, the court was of the prima facie opinion that it was a fit case to grant bail subject to furnishing a bond of Rs.1 Lakh with one surety of the like amount.
The court further directed the applicant shall not enter the limits of District Anand for a period of six months and shall mark presence once in a month for a period of six months before the police station.
