The Gujarat High Court has summoned the Law Officers branch, observing that the sessions court had "prima facie exceeded its jurisdiction" under S.483 BNSS which relates to bail, by referring its order to various state authorities for implementation of Supreme Court's directions in mob lynching cases.

Notably the sessions court had denied bail to three accused of assaulting forest and police personnel, observing that it was a land grabbing offence and the District Magistrate needs to take appropriate action.

Justice Hemant M Prachchhak said that the findings recorded by the trial Court was not justified and it was not in consonance with the facts of the present case, even though there was a legal principle as enunciated by the Supreme Court which was brought to the trial court's notice.

The Gujarat High Court has held that government employees cannot claim a right or insist that the official quarters allotted to them during service should be sold to them post retirement, adding that unauthorized occupation of Government quarters amounts to unlawful deprivation of scarce public resources. In doing so the court dismissed an appeal preferred by the President of an association challenging a trial court order which rejected his suit to continue residing in government quarters along with a prayer to purchase the quarters.

The Gujarat High Court dismissed a man's claim for possession over his relative's property despite expiry of 2-year license agreement, observing that the owner had permitted the defendant to stay at his premises gratuitously for a limited period and out of their relationship which cannot be used to claim tenancy rights. Justice JC Doshi noted that the defendant was in need of residential premises, as he was about to retire from service. The court noted that the defendant was looking for the residence for limited time period and the plaintiff out of goodwill and the relationship shared with the defendant offered his house.
