J&K High court has directed the Station House Officer (SHO) of concerned Police Station not to submit the final report in an FIR against three animal rights activists under Sections 333, 115(2), and 191(2) of the BNS without prior permission of the Court.
The petitioner had sought quashment of the FIR on the ground that it was a retaliatory measure followed by the FIR registered at their instance under Section 325 BNS and Section 11 of the Prevention of Cruelty to Animals Act, against one Dara Singh and Manga Singh, for harming two puppies.
A bench of Justice Mohd Yousuf Wani taking note of petitioners' involvement in several PILs and ongoing animal welfare efforts, directed the that investigation may continue, but final report should not to be submitted without leave of Court
The petitioners submitted that they were acting in their capacity as animal welfare workers when the false FIR was lodged against them. It was contended that instead of acting on the petitioners' complaint, the police abused their power by lodging FIR on frivolous grounds such as house trespass and rioting.
The petitioner argued that the impugned FIR was nothing more than a revenge move. It came shortly after the petitioners filed a police complaint against two men accusing them of cruelly mistreating two puppies.
the petitioners are actively involved in protecting animals and have even filed PILs (public interest litigations) in court for animal welfare.
One of the petitioner was was feeding and taking care of two puppies at their home which allegedly upset Dara Singh and his associate Manga Singh, who allegedly took the puppies away and possibly harmed them fatally.
Deeply disturbed by what happened, the petitioners filed FIR under Section 325 of the BNS and Section 11 of the Prevention of Cruelty to Animals Act, reporting the incident to the local police.
