CSR Funds Scam: Founder Of National NGO's Confederation Anand Kumar Moves Bail Application Before Kerala High Court

K.N. Anand Kumar, the founder and Managing Trustee of National NGO's Confederation who is presently in judicial custody in the CSR Scam case has approached the Kerala High Court seeking bail.
The allegation is that Anand Kumar persuaded various voluntary organizations and local representatives to secure funds by claiming that they were procuring two-wheelers, laptops, sewing machines at half price. The allegation is that booking amounts were collected by convincing everyone was that the scheme was carried out by securing the remaining amount through CSR contributions from various companies. Ananthu Krishnan, the Secretary of National NGO's Confederation and the sole proprietor of Professional Services Innovation is arrayed as the first accused.
In his bail application, Anand Kumar aged 70 years submitted that he was arrested on March 11 and is in judicial custody at hospital due to cardiac problems. It was submitted that he has already undergone angioplasty and has many age related issues.
Justice P.V.Kunhikrishnan sought instructions and posted the bail application to next week.
The specific allegation is that Anand Kumar collected rupees sixty thousand each from 1222 persons for two wheelers, rupees thirty thousand from 52 persons for laptops and over 11 lakhs from 127 persons by promising sewing machines at half prices. However, he allegedly failed to deliver the promised goods or refund the money to the beneficiaries.
Crime was registered against the Anand Kumar arraying him as second accused under 316(2), 318 (4), 61 (2) and 3 (5) of the BNS at Kannur Town Police Station.
He submitted in his bail application that he was compelled to assume the position of chairman of the National NGO's Confederation to oversee its functioning and that he has no role in the alleged CSR scam. It is stated that he has no direct nexus with any of the fraudulent allegations.
He submitted that he is the Chairman of Satya Sai Orphanage Trust which carries several charitable works. It is submitted that his absence would affect the day to day functioning of the Trust.
He also submitted that his anticipatory bail application was dismissed by Sessions Court, Thiruvananthapuram on March 11.
