Deepak Death Case: All Kerala Mens Association President Moves High Court Seeking Independent Probe, Action Against Circulating Viral Video

The President of the All Kerala Men's Association has moved the Kerala High Court seeking an investigation by an independent agency into the suicide of Deepak, who was accused of sexual harassment inside a bus by Shimjitha Musthafa in a viral video.

Shimjitha had shot a video of Deepak allegedly sexually harassing her in a moving bus in Kannur, and she posted the same on social media. The video subsequently became viral. Later, Deepak committed suicide.

Shimjitha is accused of abetment of suicide of Deepak and was arrested recently. Last week, her bail plea was rejected by the Judicial First Class Magistrate, Kunnamangalam.

The plea points to the rampant increase in fake news, morphed and defamatory content for seeking online gratification and has stated that the local police does not have the requisite expertise in such cases.

β€œThe petitioner submits that the present investigation by the local police lacks credibility and impartiality, considering the gravity of the allegations, the role of social media, and the circumstances leading to the death of the deceased. The inaction and delay on the part of the police in arresting the accused person and in preventing the destruction of digital evidence violate the right to fair investigation guaranteed under Article 21 of the Constitution of India,” states the plea.

The plea thus sought that the State be directed to entrust the investigation in the case to an independent agency like the Central Bureau of Investigation / Crime Branch / Special Investigation Team.

According to the petitioner, the registration of the crime for abetment of suicide was not sufficient and Shimjitha should be charged with murder. He had submitted a representation before the State Police Chief requesting for appropriate action in the case.

A relief is sought seeking directions to the State, State Police Chief, City Police Commissioner and Station House Officer to take immediate registration of appropriate criminal offences against the persons responsible for uploading and circulating the video.

Among other reliefs, the petitioner has also prayed for directions to the afore officials for preservation and forensic examination of all digital evidence, including mobile phones, social media accounts, and recordings.

Today, Justice K. Babu has posted the matter to February 10 for further consideration.
