Kerala High Court Grants Anticipatory Bail To YouTuber Thoppi, Says No Obscene Or Sexually Coloured Remarks Directly Made By Him
The Kerala High Court on Monday (September 28) granted anticipatory bail to controversial Malayalam gamer/Youtuber Toppi, officially known as Muhammed Nihad, who is booked for allegedly live-streaming obscene remarks about a young woman on streaming platforms. [2026 LiveLaw (Ker) 533]
Dr. Justice Kauser Edappagath observed that there were no obscene words or sexually coloured remarks spoken about the complainant and allowed the bail plea:
"I have viewed the video in question. In the said video, there is nothing to show that any obscene words or sexually coloured remarks were directly spoken by the applicant against the victim. Considering the allegations made against the applicant, his custodial interrogation seems unnecessary. For these reasons, I find this to be an appropriate case to grant pre-arrest bail to the applicant."
The prosecution allegation is that the accused persons, in furtherance of their common intention, conducted a 4-hour long live stream on the Youtube channel 'Mrz Shameer', through which they deliberately published and displayed photographs/videos of the de facto complainant without her consent, and further made obscene, sexually coloured, derogatory and defamatory remarks against her. It is further alleged that her privacy was violated with the intention of insulting her modesty, to tarnish her reputation, and humiliate her.
The offences alleged are those punishable under Sections 79 and 75(1)(iv) of the Bharatiya Nyaya Sanhita, Section 67 of the Information Technology Act, 2000 and Section 120(o) of the Kerala Police Act, 2011.
Thoppi contended that he is innocent and was falsely accused in the case. He also told that there are no materials on record to connect with the crime. The prosecution and the de facto complainant opposed the bail plea.
After hearing the parties and the alleged incriminatory video, the Court felt it fit to grant him pre-arrest bail on conditions.
Thus, the Court allowed the plea.
