The Patna High Court has granted bail to an accused in the NEET paper leak case, whose name surfaced during investigation. The Court was hearing a bail plea in connection with a case alleging a conspiracy to procure and distribute question papers before the examination.

A Single Judge Bench of Justice Ashok Kumar Pandey allowed the bail application in a case registered for offences under Sections 406, 420, 414, 467, 468, 471 and 120B of the Indian Penal Code and Section 66(c) of the Information Technology Act.

According to the prosecution, acting on suspicion, the police intercepted a van in which four persons were travelling. During the search, documents, mobile phones, electronic devices and other equipment were recovered. The occupants allegedly disclosed that, on the instructions of the mastermind behind the NEET paper leak scam, they had come to collect question papers from a bank and deliver them to the respective examination centres.

The petitioner's counsel submitted that he had been falsely implicated and that his name did not appear in the FIR. It was argued that his name surfaced only during investigation in the confessional statement of co-accused Shashi Kumar @ Kundan Kumar. Opposing the plea, the State submitted that the petitioner had criminal antecedents in two cases.

After hearing the parties and considering the facts and circumstances of the case, the Court held that the petitioner was entitled to be enlarged on bail.

Accordingly, the Court directed that the petitioner be released on furnishing a bail bond of ₹10,000 with two sureties of the like amount to the satisfaction of the ACJM-IX-cum-Sub-Judge, Patna.
