The Patna High Court has sought affidavits from the States of Bihar and Karnataka giving the “entire narration of the manner in which and the reasons for which” two persons were taken into custody in Bihar by Karnataka Police. The Court has also directed that their whereabouts and the judicial process, if any, followed in their arrest be disclosed.

A Division Bench of Justice Rajeev Ranjan Prasad and Justice Sunil Dutta Mishra was hearing a criminal writ petition concerning the alleged detention of Alok @ Ambani and Aman Kumar by Karnataka Police within Vaishali district of Bihar on 12.08.2026.

The petitioner alleged that the two persons were taken away by Karnataka Police without following the mandate of law and the guidelines laid down by the Supreme Court in this regard. It was submitted that neither the local police station was informed nor was transit remand obtained from the competent court within whose jurisdiction the persons were taken into custody.

The State of Bihar was represented by the Advocate General, assisted by Mr. Shashwat Agarwal. Considering the urgency of the matter, the Court directed the State of Karnataka through its Chief Secretary and Director General of Police to be impleaded as Respondent Nos. 5 and 6. The Court directed that notice be issued to the two respondents by registered post and through their official email.

The Court further directed:

“Since the matter requires urgent hearing, we expect that the State of Bihar as well as the State of Karnataka through their competent authorities/officers shall file their respective affidavits giving entire narration of the manner in which and the reasons for which these two persons have been taken away, they will disclose their whereabouts and the judicial process, if any, followed in the matter of their arrest.”

The matter has been listed for hearing on 16.09.2026.
