The Punjab and Haryana High Court on Tuesday took suo motu cognisance of the alleged assault on an advocate, Amit, by Haryana Police personnel in plainclothes in Chandigarh neighbouring Nayagaon, Punjab on November 30. 

The Punjab & Haryana High Court Bar Association had resolved to go on strike from December 15 due to the undue delay in the lodging of FIR.

The Court noted that an incident took place on November 30 in regard to which a written complaint was made by the victim Advocate Amit at police Station Nayagaon alleging commission of cognizable offence committed by 5-6 police officials from CIA Haryana Hisar. Despite the said complaint having being made it was alleged that no FIR was registered in respect of any cognisable offence till date even after expiry of 12 days from the date of complaint.

Chief Justice Sheel Nagu and Justice Sanjiv Berry said, "From the reading of the complaint, it prima Jacie appears that cognizable offences have been committed and vet it is not understandable as to why an FIR has not yet been registered, despite the law laid down by the ApexCourt in the case of Lalita Kumari Vs. Government of Uttar Pradesh. (2014) 2 SCC 1."

Listing the matter for December 17, the Court said, "Let the case be taken un on 17.12 2025 at 02:00 PM for the State of Punjab to explain as to why a cognizable offence has not been registered. Let an affidavit of Director General of Police, Punjab be filed by tomorrow. At this juncture, Mr. Sail Sabhlok, Senior Deputy Advocate General, Punjab appears virtually for the State of Punjab and fairly consents that the matter be taken up tomorrow and that the filing of the affidavit of the Director General of Police, Punjab, will be ensured."

Since the aforesaid order has been passed, it is expected of all the Lawyers to resume work at the earliest, it added.
